As the popularity of Cannabidiol, or CBD oil rises across the country, it’s no wonder that the product is being sold locally.

The oil comes from the cannabis plant, or hemp, and many claim it is useful in treating pain, anxiety or depression.

Unlike marijuana, hemp lacks the active chemical compound Tetrahydrocannabinol, or THC, the part that gets people high.

Marijuana is currently illegal in Texas and carries stiff penalties for anyone who buys, sells or possesses it.

So, is CBD oil legal?

The KRIS 6 News Fact Check team looked in to it, and yes, it is legal to buy, sell and possess CBD oil in Texas.

The Texas Department of State Health Services this year removed hemp from its list of dangerous drugs.

However, hemp production remains illegal in Texas, even though the 2018 Agriculture Improvement Act legalized hemp at a federal level.
