The Texas Bar & Nightclub Alliance says they plan to file a lawsuit against the State of Texas to contest new bar closure orders amid rising coronavirus cases.

Governor Greg Abbott issued a new executive order on Friday scaling back on reopening Texas after a significant surge in coronavirus cases, including closing bars and breweries, except for to-go services.

In a Facebook post on the Texas Bar & Nightclub Alliance Convention’s page, the organization stated their support for their members’ constitutional right to protest the recent order by keeping their businesses open, though they did warn of fines.

The TBNA says they plan to file a lawsuit against the State of Texas to contest these new bar closure orders.

"In light of Greg Abbott’s irresponsible and shameful actions this morning that shutter the businesses that provide a livelihood for your families and employees, we support our members in the constitutional right to protest by keeping your businesses open," the post said.

The post said members have expressed anger about being closed while other businesses such as salons and restaurants remain open.

Gov. Abbott said he took further action to mitigate the spread of COVID-19 after Texas' positivity rate rose above 10%.

“At this time, it is clear that the rise in cases is largely driven by certain types of activities, including Texans congregating in bars. The actions in this executive order are essential to our mission to swiftly contain this virus and protect public health," said Governor Abbott.
